Air Canada's recent loss in court highlights a serious issue with AI chatbots. A customer was misled by the airline's chatbot about the bereavement policy, and Air Canada tried to shirk responsibility by claiming the chatbot wasn't part of the company.

What happened

  • After his grandmother's passing, Jake Moffatt consulted Air Canada's chatbot for information about bereavement fares.

  • The chatbot provided incorrect information, stating he could receive a refund after booking his flight (Air Canada’s policy actually states they won’t provide refunds for bereavement travel after the flight is booked).

  • Air Canada refused the refund, blaming the error on the chatbot, and offered Moffatt a $200 coupon to use on a future flight.

  • Unhappy with Air Canada’s offer, Moffatt took them to small claims court and won.

Why it Matters: This case is a reminder that companies using AI need to be transparent about the current limitations of chatbots and other AI tools. If a chatbot is representing your company, you're liable for its actions.
